Wirex One
Terms of Service
1. INTRODUCTION
These Terms of Service (together with the documents referred to in them) (the "Terms") set out the legal basis on which the Wirex One application and related functionality made available through it are provided to you.
The Wirex One application is made available by cooperation of companies of the Wirex Group. Different components of the Wirex One application and associated functionalities are provided by different entities within the Wirex Group, or by licensed third-party partners, depending on your country of residence and the specific functionality used.
The Wirex One application provides two distinct categories of functionality:
1. Non-custodial wallet software, which is a technology product that does not constitute a regulated service and is provided by a software provider; and
2. crypto-related functionality, which constitutes regulated services and is provided only by authorised companies within the Wirex Group and/or by authorised third-party partners (the "Regulated Service"), as set out below (collectively referred to as "Wirex" where the context permits).
The regulatory status of each category of functionality differs, and only the Regulated Service is subject to financial regulation. References to "Wirex" in the context of regulated services mean the relevant licensed entity or partner providing those services in your jurisdiction.
In the European Economic Area (EEA):
1. Crypto-related Regulated Service in the EEA is provided, as applicable, by authorised companies within the Wirex Group and/or authorised third-party partners, including the counterparty providing certain services under clause 21.4.
2. Card-based Regulated Service is provided by Transact Payments Malta Limited, a company incorporated under the laws of Malta (company number C 91879), authorised and regulated by the Malta Financial Services Authority as an electronic money institution, pursuant to a licence from Mastercard International Incorporated.
3. Card distribution and programme management is performed by UAB Wirex, a company incorporated under the laws of Lithuania (company number 305118023), with its registered office address at Rinktines g. 5-101, LT-09234 Vilnius, Lithuania.
In the United Kingdom:
1. Regulated Service is provided by Wirex Limited, a company incorporated in England and Wales (company number 09334596), authorised and regulated by the Financial Conduct Authority as an electronic money institution (FRN 902025), with a registered office address at 9th Floor 107 Cheapside, London, United Kingdom, EC2V 6DN.
In Australia and New Zealand:
1. Regulated Service is provided by Wirex Australia PTY Ltd, a company incorporated in Australia (company number 659 803 148) with a registered office address at Governor Macquarie Tower Level 40, 1 Farrer Place, Sydney, NSW, 2000, Australia.
2. Card-based Regulated Service is provided by Novatti Group Limited ABN 98 606 556 183 of Level 3, 461 Bourke Street, Melbourne, Victoria, 3000, Australia.
Rest of the world:
1. Regulated Service is provided by DA Labs S.A.S. DE C.V., a company incorporated in El Salvador (company number 0623-130326-116-1) with a registered office address at Entre 87 y 89 AV. Norte #2, Centro de Oficinas SNBX, World Trade Center, Colonia Escalon, El Salvador.
2. Card-based Regulated Service is provided by Wirex Limited, a company incorporated in England and Wales (company number 09334596), authorised and regulated by the Financial Conduct Authority as an electronic money institution (FRN 902025), with a registered office address at 9th Floor 107 Cheapside, London, United Kingdom, EC2V 6DN.
These Terms operate alongside, and do not replace, the separate terms and conditions applicable to third-party services with which the Wirex One application interoperates. To the extent you access or use any such third-party services, you agree to comply with all applicable third-party terms and acknowledge that such services are provided independently of Wirex.
2. DISCLAIMERS
Digital asset functionality accessed through Wirex One involves a high level of risk. The value of digital assets can be highly volatile, and you may lose all of the funds you use in connection with such functionality.
Wirex does not provide custodial services in respect of your digital assets and does not hold, safeguard, or control your digital assets on your behalf. Your private keys are generated and managed by Privy as an independent infrastructure provider. Wirex has no technical ability to access, move, freeze, or reverse any transaction involving your digital assets at any time. Your ownership interaction with digital assets occurs directly through your Self-Custodial Wallet and relevant blockchain networks, and not through or via Wirex.
Certain digital asset functionality may not be regulated or may be subject to limited regulatory protections. Where this is the case, you may not have access to compensation schemes, ombudsman services, or other consumer protection mechanisms that may be available in relation to regulated financial services in your jurisdiction.
You should carefully consider whether using such functionality is appropriate for you and ensure that you understand the associated risks before accepting these Terms.
3. SERVICES
Wirex operates a technology platform accessible through the Wirex One application, which is available for download on your mobile device (the "Wirex One app"), and our website at https://wirexapp.com (the "Wirex One Web") (together - "Wirex One").
Wirex One enables you to access and use different types of functionalities. These functionalities are distinct in nature and are subject to different legal and operational frameworks, and may be available independently of one another:
1. Non-custodial wallet software, through which Wirex makes available to you a software application that enables you to create and control a self-custodial digital wallet, interact directly with public blockchain networks, smart contracts, and decentralised protocols, and manage your own digital assets using private keys that are generated and held exclusively through Privy (a third-party key management infrastructure provider) on your behalf. Wirex acts solely as a technology provider and interface layer; and
2. Regulated Services, which includes, without limitation, payment services, IBAN functionality, card products, and other regulated financial services made available through Wirex One, which may be provided by Wirex and/or third-party service providers. Such functionality is subject to availability and may be limited, restricted, or unavailable depending on your jurisdiction, applicable regulatory requirements, and internal risk policies, and may require the creation of a Wirex Profile and completion of applicable verification procedures.
You must not use Wirex One for Prohibited Activities and in Prohibited Territories.

The application is available on mobile devices and via web browser, subject to the following system requirements. For mobile use, the application supports devices running Android 8.0 or higher and iOS 17.0 or later. For the web-based application, the minimum supported browser versions are Google Chrome 71 or higher, Mozilla Firefox 74 or higher, Apple Safari 11 or higher, and Microsoft Edge (Chromium-based versions). You must have a functioning device with a stable internet connection. Additionally, a working camera is required to complete identity verification procedures.
4. YOUR SELF-CUSTODIAL WALLET
The Wirex One enables you to create and use a self-custodial digital wallet (the "Self-Custodial Wallet").
The Self-Custodial Wallet may be accessed through Wirex One or through other compatible interfaces or applications. Wirex One is one of several possible interfaces through which your Self-Custodial Wallet may be used. The Non-custodial Wallet Software, including the Self-Custodial Wallet functionality, constitutes a software product and technology service only. It is not a payment service, electronic money service, cryptoasset custody service, investment service, or any other regulated financial service under any applicable law, including, without limitation, the Payment Services Regulations 2017 (UK), the Payment Services Directive 2 (EU), the Markets in Crypto-Assets Regulation (EU) 2023/1114 ("MiCA"), or equivalent legislation in any other jurisdiction. No regulatory authorisation, licence, or registration held by any member of the Wirex Group relates to or covers the provision of the Non-custodial Wallet Software.
The Self-Custodial Wallet is a non-custodial smart contract account that enables you to directly access and manage your digital assets and interact with non-custodial functionality on Wirex One.
You retain sole control over your Self-Custodial Wallet at all times. You alone are able to authorise transactions from your Self-Custodial Wallet.
You are solely responsible for safeguarding access to your Self-Custodial Wallet, including your devices, authentication credentials, and recovery mechanisms, and for all transactions authorised through your Self-Custodial Wallet.
If you lose access to your authentication credentials or recovery mechanisms, you may permanently lose access to your Self-Custodial Wallet and any digital assets held within it. Wirex does not have the ability to recover, reset, or restore access to your Self-Custodial Wallet.
Wirex does not hold your private keys or any equivalent cryptographic means of control and has no administrative, recovery, or unilateral control rights over your Self-Custodial Wallet.
Your Self-Custodial Wallet private keys and cryptographic credentials are generated and managed by Privy Technologies, Inc. ("Privy"), an independent third-party key management infrastructure provider. Privy operates as an embedded wallet infrastructure provider and generates your private key material in a manner that ensures neither Wirex nor Privy can unilaterally access or control your digital assets. Wirex integrates Privy's infrastructure solely to provide the wallet creation and transaction signing interface within Wirex One. Your use of the Non-custodial Wallet Software is also subject to Privy's applicable terms of service. Wirex is not responsible for the acts or omissions of Privy in the provision of its key management infrastructure. Wirex does not independently store, hold, or have access to your private keys or equivalent cryptographic control.
5. BLOCKCHAIN NETWORK INTERACTION
The Self-Custodial Wallet enables you to interact directly with blockchain networks.
Through your Self-Custodial Wallet, you may:
1. engage in peer-to-peer transactions, including transferring digital assets to and from other users or blockchain addresses;
2. initiate transactions that are submitted to and executed by the relevant blockchain network; and
3. interact with decentralised applications, protocols, or smart contracts.
Your use of the Non-custodial Wallet Software and all interactions with blockchain networks, smart contracts, and decentralised protocols occur directly through your Self-Custodial Wallet and the relevant blockchain network. Wirex provides software interfaces only and, in relation to the Non-custodial Wallet Software, does not act as a custodian, intermediary, money transmitter, payment service provider, or counterparty to any transaction. Wirex does not initiate, approve, settle, or participate in the execution of any blockchain transaction. Any broadcast of a transaction to a blockchain network is initiated by you, using your private keys, through software provided by Wirex and infrastructure provided by Privy.
Blockchain networks and decentralised protocols are independent of Wirex and are not part of the services provided by Wirex. Wirex does not operate, control, or maintain any blockchain network and has no responsibility for the operation, security, or availability of such networks.
All digital asset transactions are executed directly on public blockchain networks, which are decentralised and operated by third parties, and not on any system controlled by Wirex.
Submission of a transaction does not guarantee its inclusion in a block or confirmation by the relevant blockchain network. Wirex does not guarantee that any transaction you initiate will be confirmed, processed, or completed and is not responsible for delays, failures, or network-level issues.
You are solely responsible for any network fees, gas fees, or similar charges required to process transactions on blockchain networks. Such fees are determined by the relevant blockchain network and are not set or controlled by Wirex. Wirex does not guarantee the amount, timing, or sufficiency of any such fees for transaction confirmation.
Wirex does not control how transactions are prioritised, validated, or confirmed by blockchain networks.
You are solely responsible for:
1. verifying transaction details prior to submission;
2. selecting counterparties and blockchain addresses; and
3. assessing the risks associated with interacting with blockchain networks, decentralised protocols, and smart contracts.
Transactions may be delayed, fail, or produce unexpected outcomes due to factors including:
1. network congestion or outages;
2. protocol design or limitations;
3. validator or third-party actions;
4. network forks, upgrades, or changes; or
5. vulnerabilities, bugs, or exploits in smart contracts.
Blockchain transactions are generally irreversible and cannot be modified, cancelled, or reversed once submitted.
You acknowledge that all interactions with blockchain networks are undertaken at your own risk.
6. YOUR PROFILE
Creation of a Wirex user profile (the "Wirex Profile") is required only if you wish to access Regulated Services.
To create a Wirex Profile, you must provide the required information, including an email address and security credentials, and complete identity verification procedures.
The creation or existence of a Wirex Profile does not affect the non-custodial nature of your Self-Custodial Wallet, and digital assets held in your Self-Custodial Wallet remain under your sole control.
Wirex does not guarantee that a Wirex Profile will be made available to you or that access to any Regulated Service will be granted or maintained.
You must ensure that all information provided in connection with your Wirex Profile is accurate and up to date and must comply with any requests for additional information, including in relation to identity verification and source of funds, as required by applicable law or Wirex's policies.
You are responsible for maintaining the security of your Wirex Profile and any credentials associated with it. Credentials used to access your Wirex Profile are separate from, and do not replace, the authentication credentials used to control your Self-Custodial Wallet.
To be eligible to create a Wirex Profile, you must meet the following criteria:
1. you must be at least 18 years of age and resident in a supported jurisdiction;
2. you must not be from a Prohibited Territory;
3. you must not be subject to sanctions or appear on any applicable sanctions list;
4. you must successfully complete all required verification and compliance checks.
You must not create or maintain more than one Wirex Profile, and any duplicate or additional profiles may be suspended or terminated by Wirex.
You have the right to cancel your Wirex Profile within fourteen (14) calendar days from the day after its creation by notifying Wirex through the available customer care channels.
If you cancel your Wirex Profile within this period, your Wirex Profile and access to Regulated Service will be terminated. Any associated account will be closed subject to completion or cancellation of any pending Regulated Service and to any instructions required under applicable law. Your Self-Custodial Wallet will remain unaffected and under your sole control.
You may be required to pay for any services already provided at your express request before cancellation, but only where you were informed of the cost in advance and agreed to such services being performed before the end of the cancellation period.
The right to cancel does not apply to services under Regulated Service that have already been fully performed and any transactions carried out through your Self-Custodial Wallet, which are irreversible by their nature.
The suspension, restriction, or termination of a Wirex Profile does not give Wirex control over, or access to, your Self-Custodial Wallet.
7. YOUR PROFILE VERIFICATION
In order to access Regulated Service of Wirex One, you may be required to complete identity verification procedures and provide information about yourself. Verification requirements may vary depending on the specific services you access, your jurisdiction, and applicable regulatory requirements. You must successfully complete our identity verification process. This includes, but is not limited to, providing:
1. a valid, government-issued photo ID;
2. proof of residential address dated within the last 6 months;
3. completing biometric, liveness, or similar identity verification checks through our approved third-party provider, where required; and
4. any additional documentation we may reasonably request.
In certain circumstances, we may require enhanced due diligence. This may involve:
1. providing further personal, financial, or business-related information;
2. information regarding the source of your funds and/or wealth;
3. submitting additional supporting documents or financial statements;
4. participating in a live video call or an in-person meeting with a Wirex representative or other relevant third-party partner.
You authorise Wirex to conduct identity verification checks, either directly or via approved third-party providers.
You acknowledge that, as part of our verification and compliance checks, we may use identity verification services, sanctions screening databases, credit reference agencies, fraud prevention bodies, and relevant third-party partners.
You acknowledge that, where certain services are provided by third-party providers, such providers may independently perform identity verification, customer due diligence, and ongoing monitoring in accordance with their own legal and regulatory obligations.
You are responsible for ensuring all information provided is accurate, truthful, and up to date. If your details change, you must update your information promptly. Inaccurate or outdated information may lead to restricted access to certain functionalities on Wirex One.
Wirex may monitor activity conducted through Wirex One, including profile activity, Regulated Service for compliance, sanctions, fraud prevention and security purposes. This monitoring does not mean that Wirex controls, intermediates or can reverse blockchain transactions.
We reserve the right to reject your registration on Wirex One if your identity cannot be verified or if any documentation you provide is incomplete, invalid, or suspected to be fraudulent.
8. YOUR PAYMENT ACCOUNT
Your Profile provides access to Regulated Services, which may include access to a payment account or similar mechanism made available through regulated third-party service providers (the "Account") solely for the purpose of facilitating transactions.
You may initiate fiat-related transactions using supported methods, including bank transfers, payment instruments, or conversion of digital assets, through functionality made available within your Profile.
We may refuse payments from bank accounts or payment instruments not registered in your name. You are responsible for ensuring that all payment details provided are accurate and complete, as well as for any fees charged by your bank or payment provider.
Where you initiate a transfer, you must ensure that the currency sent matches the selected currency of your Account. If you send a different or unsupported currency, conversion fees, delays, or rejection of the payment may apply.
You acknowledge and agree that exchange rates displayed prior to execution are indicative and may change before your transaction is executed. The applicable exchange rate will be fixed at the time your order is executed, and you bear any risk arising from any fluctuations prior to such execution.
Where a payment transaction is made through your Wirex Profile, your rights and liabilities in respect of unauthorised or incorrectly executed transactions will be governed by applicable law.
You must notify Wirex without undue delay if you become aware of any unauthorised or incorrectly executed payment transaction carried out through Regulated Services.
To the extent permitted by applicable law, Wirex shall not be liable for any losses resulting from unauthorised access to your email account, device, or other third-party services, unless such access results from Wirex's breach of its obligations in relation to the Regulated Service.
9. ACCOUNT IDENTIFIERS
Wirex One may enable access to Regulated Service through the use of bank account identifiers, including, without limitation, virtual IBANs ("vIBANs"), sort codes and account numbers, or other local bank account details assigned to you (the "Account Identifiers") as part of the Regulated Service of Wirex One.
Account Identifiers may allow you to receive funds to, and send payments using, such account identifiers using supported payment rails and currencies, including, without limitation, SEPA, Faster Payments, or Automated Clearing House ("ACH").
Account Identifiers are provided through Wirex's integration with one or more regulated third-party service providers that facilitate the underlying payment infrastructure. You acknowledge and agree that:
1. Wirex does not operate or control the underlying payment infrastructure;
2. such account identifiers are issued, assigned, and maintained by the relevant third-party service providers; and
3. your use of Account Identifiers may be subject to additional terms and conditions imposed by such third-party service providers.
Account Identifiers form part of the regulated functionality of Wirex One and are separate from the Self-Custodial Wallet and any non-custodial or blockchain-based functionality described elsewhere in these Terms.
Wirex may, acting reasonably and in accordance with applicable law:
1. assign, withdraw, or suspend any account identifiers allocated to you;
2. suspend, restrict, or terminate your access to the Account Identifiers; or
3. modify or discontinue Account Identifiers, including where any third-party service provider modifies or terminates its services.
10. YOUR CARD AND CARD SERVICES
You may request a payment card (the "Wirex Card") through Wirex One, which operates under the rules of the applicable card schemes (such as Visa or Mastercard).
Before using your Wirex Card, you must activate it in accordance with the instructions provided at the time of delivery. Activation constitutes your confirmation that you agree to be bound by these Terms and is required to enable card functionality. Upon receipt, you must sign the back of the card in the designated area.
To set up your Personal Identification Number (PIN), you must follow the instructions available within your Profile. Your PIN is required to complete certain transactions, including ATM withdrawals and chip-and-PIN payments. You may also be required to specify preferred currencies for your Wirex Card.
A transaction is authorised when you enter your PIN, use contactless functionality, provide card credentials online, or confirm the transaction in-app. Once authorised, a transaction may not be cancellable by you through Wirex One, although you may have refund, dispute or chargeback rights under applicable law, card scheme rules, or the relevant issuer terms.
You may use your Wirex Card to authorise payment transactions, where accepted, using digital assets held in your Self-Custodial Wallet.
When you use your Wirex Card, the corresponding transaction will be authorised by you and executed through the interaction of your Self-Custodial Wallet with relevant payment infrastructure and third-party service providers.
Transactions made using the Wirex Card may involve the conversion of digital assets into fiat currency or equivalent value through third-party service providers prior to settlement with the relevant merchant or payment network.
You must ensure that sufficient digital assets are available in your Self-Custodial Wallet at the time of authorisation to cover the full amount of any transaction, including applicable fees and foreign exchange costs. Where sufficient assets are not available, transactions may be declined. Wirex and/or relevant third-party service providers may also require source-of-funds or other compliance checks.
Where a transaction is made in a currency different from your Wirex Card currency, applicable exchange rates (including those set by the relevant card scheme or service providers) and any associated mark-ups or fees will apply. The final settlement amount may differ from the amount authorised.
The Wirex Card does not provide any credit facility. Transactions attempted without sufficient available assets may be declined.
Where a merchant issues a refund, the amount will be credited once received from the relevant card scheme or issuer. This may take several business days. Where the refund currency is not supported, it may be converted at applicable exchange rates and fees.
You may request a chargeback only in accordance with applicable card scheme rules (such as Visa or Mastercard rules). Supporting evidence may be required. The outcome and processing timeframe are determined by the relevant card scheme. Disputes with merchants or ATM operators must be addressed directly with them where required.
Transactions may be declined due to insufficient assets, applicable limits, security or regulatory checks, or merchant or network acceptance rules.
You may initiate a transfer to an external Visa or Mastercard (the "Recipient Card") using the Account-to-Card ("Pay-to-Card") service, subject to availability, using digital assets held in your Self-Custodial Wallet.
Such transfers are executed through the interaction of your Self-Custodial Wallet with payment infrastructure and third-party service providers and may involve conversion of digital assets into fiat currency or equivalent value prior to settlement. Account-to-Card transfers are funds transfers and do not constitute card purchase transactions.
Once authorised and completed, transfers are final, may be irreversible, and chargeback rights applicable to card purchases do not apply.
Transfers may be delayed, declined, or partially completed due to AML or sanctions requirements, risk controls, applicable limits, geographic restrictions, technical issues, third-party dependencies, or card scheme rules. Processing times are determined by the Recipient Card issuer and relevant service providers.
Transfers are subject to applicable limits, supported countries and currencies, and fees as displayed within Wirex One. Exchange rates and fees applied by third-party service providers and payment networks may also apply.
You must ensure that Recipient Card details are accurate. Wirex is not responsible for misdirected transfers resulting from incorrect information. Attempts to recover funds may be made where requested, but recovery is not guaranteed and may incur a fee.
Wirex or relevant third-party service providers may request additional information or documentation and may pause, delay, or decline transfers where required by applicable law, card scheme rules, or internal risk policies.
Your Wirex Card will expire on the date indicated on the card. A replacement card may be issued or made available upon request. Expired physical cards should be securely destroyed.
11. PROFILE CLOSURE, SUSPENSION AND TERMINATION
You may request to close your Wirex Profile at any time by contacting Wirex through available customer support channels. Closure may be delayed or restricted while an investigation, compliance review, sanctions review, fraud review or other legal process is ongoing, to the extent permitted or required by applicable law. This does not affect your sole control over your Self-Custodial Wallet.
Upon closure of your Wirex Profile:
1. access to Regulated Service will be terminated; and
2. any ongoing or pending transactions initiated through Regulated Service may be completed, cancelled, or restricted in accordance with applicable requirements.
Wirex may suspend, restrict, or terminate your Wirex Profile and access to Regulated Service at any time where:
1. you breach these Terms;
2. we reasonably suspect fraud, misuse, or provision of false or misleading information;
3. this is required to comply with applicable law, regulation, court orders, or directions from a competent authority;
4. required as part of AML, sanctions, or risk management processes; or
5. continued provision of services may expose Wirex or third parties to risk.
Wirex may also suspend or restrict access to your Wirex Profile while investigating suspected breaches or suspicious activity, where continued access could result in harm or regulatory breach.
Where permitted by law, Wirex will notify you of any suspension or termination of your Wirex Profile or access to Regulated Services. Such notification, however, may be delayed or withheld where Wirex is not permitted to provide it. Wirex may also terminate your Wirex Profile or access to Regulated Service at any time by providing you with at least two (2) months' notice.
The suspension, restriction, or termination of a Wirex Profile does not affect your Self-Custodial Wallet, which remains under your sole control and is not accessible to Wirex.
Following closure, you may still be required to complete or cooperate with any compliance processes required by applicable law.
Nothing in this section limits or affects your statutory rights under applicable law.
12. NOTICE AND COMMUNICATIONS
We will get in touch with you through the Wirex One or the email address you provide on your Profile. Please make sure to keep this updated with an email address you check regularly. Any communications will be made in English.
13. CUSTOMER CARE
If you require assistance, wish to submit a request, provide feedback, or raise a complaint, you may contact our Customer Care team via:
1. the in-app chat functionality available within Wirex One, through which you may submit your query and receive support from a customer support agent; and/or
2. email at supportescalations@wirexapp.com.
The in-app chat enables you to communicate directly with a support agent.
Through the in-app chat, you may submit general enquiries, request assistance in relation to the use of Wirex One, report technical issues, and submit an initial complaint.
The availability of chat support and response times may vary depending on demand, issue complexity, and operational factors.
Where you submit a complaint, whether via in-app chat or email, it will be handled in accordance with our Complaints Policy.
If your complaint relates specifically to card transaction services, and you have already contacted our Customer Care team, you may escalate the issue to the relevant card issuer. The provider's complaint handling process, timelines and external dispute resolution routes will apply to the extent required by applicable law.
In particular, complaints relating to the Wirex Card in EEA may be escalated to Transact Payments Malta Limited (TPML) by emailing complaints@transactpaymentslimited.com.
Information regarding external dispute resolution bodies and procedures is available upon request or on our website. In particular:
1. United Kingdom: if you are a consumer and are not satisfied with our response to your complaint, you may be able to refer your complaint to the Financial Ombudsman Service (FOS) at www.financial-ombudsman.org.uk, or, for payment-related disputes, the Payment Systems Regulator.
2. European Economic Area: if you are a consumer, you may be able to refer your complaint to the relevant national competent authority or financial ombudsman in your country of residence, or use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
3. Australia: if you are not satisfied with our response, you may contact the Australian Financial Complaints Authority (AFCA) at www.afca.org.au (telephone: 1800 931 678), subject to AFCA's membership and jurisdiction rules as applicable from 1 July 2026.
4. Other jurisdictions: further information regarding available dispute resolution mechanisms is available on our website.
In the event that you need to access a deceased's Profile, please contact us. We may ask you for supporting documentation, such as a death certificate, probate documents, or other documents proving you have the right to administer the deceased's estate.

14. OUR RESPONSIBILITY TO YOU
Wirex One enables you to access functionality, content, and services that may be provided by third parties or operate on third-party infrastructure, including blockchain networks and payment systems. Wirex does not control such third-party services, products, or content and is not responsible for their availability, performance, or outcomes.
Wirex shall not be liable for any delay or failure to perform its obligations under these Terms resulting from events beyond its reasonable control, including, without limitation, natural disasters, internet or network outages, government actions, cyberattacks, or failures of third-party infrastructure.
Where you use Regulated Services in breach of these Terms, or where a technical or processing error results in an unintended benefit to you in connection with such functionality, Wirex may take reasonable steps to recover any amounts due in connection with Regulated Services, including by restricting or suspending access to such functionality or offsetting amounts processed through it, in each case in accordance with applicable law.
Wirex One is provided on an "as is" and "as available" basis. To the extent permitted by law, Wirex makes no representations or warranties as to the suitability, reliability, availability, or fitness of Wirex One for your particular purposes.
To the extent permitted by law, Wirex's total liability to you for any claim arising under or in connection with these Terms shall be limited to the total amount of fees paid by you to Wirex in the twelve (12) months preceding the claim.
Wirex shall not be liable for any loss that is not reasonably foreseeable or that results from your failure to comply with these Terms.
15. YOUR RESPONSIBILITIES
You are responsible for:
1. all fees, charges, and obligations arising from your use of Wirex One, including those incurred through Regulated Services;
2. complying with all applicable laws, regulations, and obligations in your jurisdiction, including those relating to taxation, financial reporting, and the use of digital assets; and
3. ensuring that your use of Wirex One does not breach applicable sanctions, export controls, or other legal restrictions.
You are responsible for maintaining access to and control over your Self-Custodial Wallet, including safeguarding your authentication credentials, devices, and recovery mechanisms, and for all transactions authorised through your Self-Custodial Wallet.
You are responsible for maintaining copies of any information or data you upload or store through Wirex One. Wirex is not responsible for any loss of data or loss of access resulting from the suspension, restriction, or termination of your access to Wirex One.
16. WIREX REMEDIES
Where you breach these Terms, or where required to comply with applicable law, regulation, or risk management obligations, Wirex may take reasonable and proportionate action, including:
1. contacting or providing relevant information to third parties, including payment service providers, card schemes, financial institutions, law enforcement, or regulatory authorities, where permitted or required by law;
2. refusing, suspending, or restricting access to Regulated Services or declining to process transactions;
3. modifying, cancelling, or preventing the execution of transactions initiated through Regulated Services prior to their completion, where permitted under applicable rules; and
4. pursuing legal action or taking other enforcement measures against you.
The remedies set out in this section apply solely to Regulated Services and do not apply to your Self-Custodial Wallet or any digital assets held therein, over which Wirex has no access or control.
17. YOUR PERSONAL DATA
How we collect, use, share, and retain your personal data is explained in our Wirex One Privacy, Data Use and Retention Policy, available at [insert link]. This includes information about identity verification and any biometric or liveness checks, sanctions screening, fraud prevention checks, credit reference agencies, and relevant third-party partners, where applicable.
18. INTELLECTUAL PROPERTY
All intellectual property rights in the Wirex One, and all content and logos are owned by or licensed to Wirex. You may not copy, imitate, or use any of this intellectual property without our prior written consent. Nothing in these Terms grants you any intellectual property rights in the Wirex One, other than the right to use the Wirex One, and to download Wirex App on your device in order to access the Wirex One, in accordance with these Terms.
Your right to use the Wirex One is personal to you and you are not allowed to give this right to any other person. Your right to use the Wirex One does not stop us from giving other people the right to use the Wirex One.
19. APPLE APP STORE PROVISIONS
This Section applies where the Wirex App has been acquired from the Apple App Store. You acknowledge and agree that the Terms are solely between you and Wirex, not Apple, Inc. ("Apple") and that Apple has no responsibility for the App or content thereof. Your use of the Wirex App must comply with the App Store Terms of Service.
You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and (where applicable) Apple will refund the purchase price for the Wirex App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Wirex App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be solely governed by the Terms and any law applicable to Wirex as provider of the Wirex App.
You acknowledge that Apple is not responsible for addressing any claims of you or any third party relating to the Wirex App or your possession and/or use of the Wirex App, including, but not limited to:
1. product liability claims;
2. any claim that the Wirex App fails to conform to any applicable legal or regulatory requirement; and
3. claims arising under consumer protection or similar legislation;
and all such claims are governed solely by the Terms and any law applicable to Wirex as provider of the software.
You acknowledge that, in the event of any third-party claim that the Wirex App or your possession and use of that Wirex App infringes that third party's intellectual property rights, Wirex, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim to the extent required by the Terms.
You represent and warrant that:
1. you are not located in a country that is subject to U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and
2. you are not listed on any U.S. Government list of prohibited or restricted parties.
You and Wirex acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of the Terms of Service as relates to your license of the App, and that, upon your acceptance of the terms and conditions of the Terms of Service, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms of Service as relates to your license of the App against you as a third-party beneficiary thereof.
20. OTHER APP DISTRIBUTION PLATFORM PROVISIONS
Where you download our Wirex App from any other app store or distribution platform other than the Apple App Store, including the Google Play Store (the "Distribution Platform") you agree that:
1. these Terms are between you and Wirex, and not with the provider of the Distribution Platform ("Store Provider");
2. your use of the Wirex App must comply with the Store Provider's then-current Distribution Platform Terms of Service;
3. the Store Provider is only a provider of the Distribution Platform where you obtained the Wirex App;
4. Wirex, and not the Store Provider, is solely responsible for the Wirex App;
5. the Store Provider has no obligation or liability to you with respect to the Wirex App or the Terms; and
6. you acknowledge and agree that the Store Provider is a third-party beneficiary to the Terms as it relates to the Wirex App.
21. AMENDMENTS TO THESE TERMS
21.1 We may change these Terms from time to time. Except where clause 21.2 applies, we will notify you of any change at least two (2) months before the date on which it takes effect. Notice will be given in a durable medium. You will be treated as having accepted the change unless you tell us before the effective date that you do not accept it. If you do not accept the change, you have the right to terminate these Terms and close your Profile immediately and free of charge at any time before the effective date.
21.2 We may make the following changes with shorter notice or with immediate effect:
21.2.1 changes to interest or exchange rates that are based on the reference rates identified in our Fees and Limits;
21.2.2 changes required by a change in applicable law or by a binding instruction of a competent authority, where the law or instruction requires the change to take effect on a date earlier than two months from notification;
21.2.3 changes that are unambiguously in your favour (for example, a reduction in fees, a removal of a restriction, or a new service made available to you at no charge); and
21.2.4 changes to operational or technical information referenced in these Terms (such as supported app versions, supported browsers, or support contact details) that do not affect your rights or our obligations under these Terms.
21.3 We will tell you about any changes to these Terms made under this clause as soon as reasonably practicable after they take effect.
21.4 If you are an EU located customer, you must make yourself aware of and accept the terms of service of our counterparty providing certain services as set out in these terms: www.crossmint.com/legal/terms-of-service.
22. MISCELLANEOUS
These Terms shall be governed and interpreted in accordance with laws of England and Wales.
Unless stated otherwise in these Terms, if any provision is found to be invalid or unenforceable by a court or competent authority, such provision shall be deemed modified or, if necessary, struck out to the extent required, and the remainder of these Terms shall remain in full force and effect.
The failure or delay by Wirex in exercising any right or enforcing any provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be made in writing to be effective. All rights and remedies under these Terms are cumulative and not exclusive of any rights or remedies provided by law.
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Wirex may assign or transfer its rights or obligations under these Terms at any time without notice. No third party shall have any rights to enforce any part of these Terms.
Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of England and Wales without prejudice to any rights the user may have under the laws of their country of residence or domicile, including the right to bring a claim before the courts of that country. Nothing in these Terms shall affect the user's statutory rights as a consumer under the laws of their country.
In the event of a dispute arising from the interpretation and/or application of these Terms:
1. If you are a consumer resident in the United Kingdom, these Terms and any non-contractual obligations arising out of them are governed by the law of England and Wales.
2. For all other users, the competent court shall be that of your domicile or residence, unless otherwise required by applicable mandatory law.
