Wirex One
Terms of Service
1. Introduction
1.1. These Terms of Service (together with the documents referred to in them) (the "Terms") set out the legal basis on which the Wirex One application and related functionality made available through it are provided to you.
1.2. Wirex operates a technology platform accessible through the Wirex One mobile application available for download on your mobile device (the "Wirex One App") and the Wirex One web platform available at https://one.wirexapp.com (the "Wirex One Web") (together, "Wirex One").
1.3. The Wirex One application is made available by cooperation of companies of the Wirex Group. Different components of the Wirex One application and associated functionalities are provided by different entities within the Wirex Group, or by licensed third-party partners, depending on your country of residence and the specific functionality used.
1.4. Wirex One provides the following categories of functionality, which are distinct in nature and subject to different legal, regulatory and operational frameworks and may be available independently of one another:
(a) Self-Custodial Wallet functionality, which enables you to create and control a self-custodial digital wallet and manage digital assets using private keys associated with that wallet. The private keys are generated and managed through Privy, a third-party key management infrastructure provider. The Self-Custodial Wallet is a technology product and does not constitute a regulated financial service;
(b) On-Chain functionality, which enables you, through your Self-Custodial Wallet, to access and interact directly with blockchain networks, protocols, smart contracts, decentralised applications and other blockchain-based technologies, systems, mechanisms, infrastructure, functionality or arrangements that may be available from time to time (collectively, "On-Chain Infrastructure"). Any interaction with On-Chain Infrastructure is initiated, authorised and controlled solely by you using your private keys; and
(c) Regulated functionality, including crypto-asset services, payment services, IBANs, and card products and other regulated financial services, which are provided only by authorised companies within the Wirex Group and/or by authorised third-party partners (the "Regulated Services"), as set out below (collectively referred to as "Wirex" where the context permits).
1.5. The regulatory status of each category of functionality differs. Self-Custodial Wallet Functionality and On-Chain Functionality are technology functionalities that facilitate your direct interaction with On-Chain Infrastructure and do not constitute Regulated Services. Only Regulated Services are subject to applicable financial services regulation.
1.6. Wirex provides Wirex One as a non-custodial technology interface. Except in relation to Regulated Services, Wirex does not custody digital assets, hold or control private keys, operate any On-Chain Infrastructure, initiate or authorise transactions on your behalf, or act as broker, intermediary, trustee, fiduciary, agent or counterparty in relation to any interaction with On-Chain Infrastructure. All transactions and interactions with On-Chain Infrastructure are initiated and controlled solely by you.
1.7. References to "Wirex" in these Terms mean the relevant Wirex Group entity or authorised third-party partner responsible for the provision of Regulated Services.

2. Disclaimers
2.1. Digital asset functionality accessed through Wirex One involves a high level of risk. The value of digital assets can be highly volatile, and you may lose all of the funds you use in connection with such functionality.
2.2. Wirex does not provide custodial services in respect of your digital assets and does not hold, safeguard, or control your digital assets on your behalf. Your private keys are generated and managed by Privy as an independent infrastructure provider. Wirex has no technical ability to access, move, freeze, or reverse any transaction involving your digital assets at any time. Your ownership interaction with digital assets occurs directly through your Self-Custodial Wallet and relevant blockchain networks, and not through or via Wirex.
2.3. Certain digital asset services may not be regulated or may be subject to limited regulatory protections. Where this is the case, you may not have access to compensation schemes, ombudsman services, or other consumer protection mechanisms that may be available in relation to regulated financial services in your jurisdiction.
2.4. You should carefully consider whether using such functionality is appropriate for you and ensure that you understand the associated risks before accepting these Terms.
2.5. Without limitation, the risks associated with On-Chain Functionality and On-Chain Infrastructure include:
(a) On-Chain Infrastructure risk: On-Chain Infrastructure, including any interconnected or underlying On-Chain Infrastructure on which it depends, may malfunction, be exploited, become insolvent, be abandoned, or otherwise fail, including due to coding errors, malicious code ("rug pulls"), governance decisions, oracle failures, liquidity shortfalls, infrastructure failures, or other unforeseen events;
(b) smart contract risk: smart contracts are experimental, may contain undiscovered errors, vulnerabilities or design flaws, and may not operate as intended. There is no assurance that security reviews or audits have identified all risks or weaknesses;
(c) bridging and wrapping risk: wrapped, bridged, synthetic or derivative representations of digital assets may lose their peg, parity, liquidity or redeemability due to bridge failures, infrastructure failures, insolvency events, smart contract failures or other factors;
(d) redemption and withdrawal risk: access to, redemption from, or withdrawal from On-Chain Infrastructure may be delayed, restricted, suspended or unavailable due to cooldown periods, queues, redemption gates, rate limits, insufficient liquidity, governance decisions or other restrictions imposed by the relevant On-Chain Infrastructure;
(e) price and information risk: displayed balances, prices, yields, rewards or valuations may be derived from third-party sources, may be stale, indicative or inaccurate, and may differ materially from actual on-chain execution or settlement outcomes;
(f) dependency and composability risk: On-Chain Infrastructure may be interconnected with, dependent upon, or exposed to other infrastructure, protocols, smart contracts, validators, bridges or blockchain networks, meaning failures affecting one component may adversely affect another component;
(g) regulatory risk: legal, regulatory, enforcement or policy developments may adversely affect the availability, legality, accessibility, operation or functionality of any On-Chain Infrastructure and may result in functionality being restricted, suspended or discontinued;
(h) irreversibility risk: blockchain transactions are generally irreversible once confirmed and cannot ordinarily be cancelled, modified or reversed, including where submitted in error or as a result of fraud, compromise or mistake;
(i) network and security risk: blockchain networks may experience outages, congestion, forks, upgrades, consensus failures, validation failures, undiscovered technical vulnerabilities, cyberattacks or malicious activity that may adversely affect transactions or digital assets; and
(j) emerging technology risk: On-Chain Infrastructure, smart contracts and blockchain-based technologies are rapidly evolving, relatively untested technologies that may be subject to risks that are unknown or not reasonably foreseeable.
2.6. Transactions may be delayed, fail, or produce unexpected outcomes due to factors including network congestion, validator activity, network forks, protocol limitations, governance actions, software defects, smart contract vulnerabilities, infrastructure outages, third-party failures, or other circumstances outside Wirex's control.
2.7. Where On-Chain Infrastructure lends, stakes, transfers, pools, deploys, rehypothecates or otherwise utilises digital assets in accordance with its own rules, governance arrangements or smart contract logic, there is a risk that such digital assets may be lost, become inaccessible, be subject to delays, or decrease in value. Such risks may arise where:
(a) digital assets are deployed into liquidity pools, lending pools, staking arrangements or similar mechanisms that become under-collateralised, exploited, liquidated or otherwise fail;
(b) the relevant On-Chain Infrastructure experiences bad debt, collateral shortfalls, insolvency events, liquidity constraints or loss socialisation mechanisms; or
(c) market conditions, governance actions, oracle failures or other operational factors adversely affect redemption values, withdrawal rights, liquidity availability or reward structures.
2.8. You acknowledge that the events described in this Section may reduce or eliminate the quantity or value of digital assets ultimately returned to you following any withdrawal, redemption or other interaction with On-Chain Infrastructure.
2.9. To the maximum extent permitted by applicable law, Wirex does not guarantee, insure, compensate, reimburse or make you whole for any loss, reduction in value, delay, restriction, failure, insolvency event, security incident or other adverse outcome arising from or relating to any On-Chain Infrastructure, blockchain network, smart contract, Third-Party Provider or related technology.
3. Your Self-Custodial Wallet
3.1. The Wirex One enables you to create and use a self-custodial digital wallet (the "Self-Custodial Wallet").
3.2. The Self-Custodial Wallet may be accessed through Wirex One or through other compatible interfaces or applications. Wirex One is one of several possible interfaces through which your Self-Custodial Wallet may be used.
3.3. The Self-Custodial Wallet is a non-custodial smart contract account that enables you to directly access and manage your digital assets and interact with on-chain functionality on Wirex One.
3.4. You retain sole control over your Self-Custodial Wallet at all times. You alone are able to authorise transactions from your Self-Custodial Wallet.
3.5. You are solely responsible for safeguarding access to your Self-Custodial Wallet, including your devices, authentication credentials, and recovery mechanisms, and for all transactions authorised through your Self-Custodial Wallet.
3.6. If you lose access to your authentication credentials or recovery mechanisms, you may permanently lose access to your Self-Custodial Wallet and any digital assets held within it. Wirex does not have the ability to recover, reset, or restore access to your Self-Custodial Wallet.
3.7. Wirex does not hold your private keys or any equivalent cryptographic means of control and has no administrative, recovery, or unilateral control rights over your Self-Custodial Wallet.
3.8. Your Self-Custodial Wallet private keys and cryptographic credentials are generated and managed by Privy Technologies, Inc. ("Privy"), an independent third-party key management infrastructure provider. Privy operates as an embedded wallet infrastructure provider and generates your private key material in a manner that ensures neither Wirex nor Privy can unilaterally access or control your digital assets. Wirex integrates Privy's infrastructure solely to provide the wallet creation and transaction signing interface within Wirex One. Your use of the Self-Custodial Wallet is also subject to Privy's applicable terms of service. Wirex is not responsible for the acts or omissions of Privy in the provision of its key management infrastructure. Wirex does not independently store, hold, or have access to your private keys or equivalent cryptographic control.
3.9. Wirex is not authorised to accept or hold crypto assets deposited to a blockchain address associated with the legacy Wirex application. Where such a deposit is identified, Wirex will return the deposited assets to your Self-Custodial Wallet address already verified in Wirex One App.
4. On-Chain Functionality
4.1. The Self-Custodial Wallet enables you to interact directly with the On-Chain Infrastructure.
4.2. Through your Self-Custodial Wallet, you may:
(d) engage in peer-to-peer transactions, including transferring digital assets to and from other users or blockchain addresses;
(e) initiate transactions that are submitted to and executed by the relevant blockchain network; and
(f) interact with decentralised applications, protocols, or smart contracts.
4.3. Your use of the Self-Custodial Wallet and all interactions with On-Chain Infrastructure occur directly through your Self-Custodial Wallet. Wirex provides a non-custodial software interface only and does not custody digital assets, hold or control private keys, operate any On-Chain Infrastructure, initiate, authorise, settle or participate in the execution of any transaction, or act as a custodian, intermediary, money transmitter, payment service provider or counterparty. All transactions are initiated, authorised and controlled solely by you using your private keys.
4.4. On-Chain Infrastructure is independent of Wirex and does not form part of the services provided by Wirex. Wirex does not operate, control, maintain or assume responsibility for the operation, security, availability or performance of any On-Chain Infrastructure.
4.5. Submission of a transaction does not guarantee its inclusion in a block or confirmation by the relevant blockchain network. Wirex does not guarantee that any transaction you initiate will be confirmed, processed, or completed and is not responsible for delays, failures, or network-level issues.
4.6. You are solely responsible for any network fees, gas fees, or similar charges required to process transactions on blockchain networks. Such fees are determined by the relevant blockchain network and are not set or controlled by Wirex. Wirex does not guarantee the amount, timing, or sufficiency of any such fees for transaction confirmation.
4.7. You are solely responsible for:
(a) verifying transaction details prior to submission;
(b) selecting counterparties and blockchain addresses; and
(c) assessing the risks associated with interacting with blockchain networks, decentralised protocols, and smart contracts.
4.8. Blockchain transactions are generally irreversible and cannot be modified, cancelled, or reversed once submitted.
4.9. Any rights, obligations, functionality, restrictions or risks arising from your interaction with On-Chain Infrastructure arise solely under the applicable rules, governance arrangements and smart contract logic of that On-Chain Infrastructure and not with Wirex. Wirex is not a party to any such interaction and assumes no responsibility for any rights, obligations, liabilities, losses or claims arising from or in connection with it.
4.10. Where you transfer digital assets from your Self-Custodial Wallet to On-Chain Infrastructure in order to access its functionality, including lending, staking, liquidity provision, or other decentralised activities, such digital assets are no longer held in your Self-Custodial Wallet and become subject solely to that On-Chain Infrastructure's own terms and smart contract logic. The timeliness and availability of any such transfer may vary depending on on-chain conditions or the relevant On-Chain Infrastructure's own terms or smart contract logic.
4.11. Following such a transfer, the On-Chain Infrastructure or its associated smart contracts may automatically convert, wrap, or otherwise transform the transferred digital assets into another type of digital asset required for that On-Chain Infrastructure to perform its functions. Such conversions occur on-chain, under the control of the relevant On-Chain Infrastructure or its smart contracts, and outside Wirex's control or responsibility.
4.12. Where On-Chain Infrastructure lends, stakes, transfers, or otherwise deals with digital assets in accordance with its own terms, governance, code, or smart contract logic, there is a risk that those digital assets may be lost, become inaccessible, or depreciate in value, including where digital assets are deployed into liquidity or lending pools that are subsequently liquidated, under-collateralised, exploited, or otherwise fail, or where the On-Chain Infrastructure incurs bad debt or a shortfall in collateral. You acknowledge that such events may reduce or eliminate the digital assets ultimately returned to you on a withdrawal or redemption.
4.13. Following a transfer to On-Chain Infrastructure, your Self-Custodial Wallet may receive receipt tokens, derivative tokens, or other digital representations evidencing your on-chain position or claim in relation to digital assets deposited with, or managed by, that On-Chain Infrastructure. Such tokens are created, managed, and governed by the relevant On-Chain Infrastructure or its community. Wirex does not issue, custody, select, approve, recommend, or endorse any such tokens, and does not guarantee their value or redeemability.
4.14. You may initiate a transfer of digital assets from On-Chain Infrastructure back to your Self-Custodial Wallet in accordance with that On-Chain Infrastructure's own functionality and terms, and any digital assets converted or wrapped on transfer to the On-Chain Infrastructure may be re-converted or unwrapped on such a transfer back. The timeliness and availability of such a transfer may vary depending on On-Chain Infrastructure liquidity, on-chain conditions, or the On-Chain Infrastructure's own terms or smart contract logic, and Wirex has no control over, and is not liable for, any delay, restriction, error, or failure relating to it.
4.15. Wirex One may display aggregated or summarised information about digital assets transferred to or from On-Chain Infrastructure, including balances, yields, or receipt tokens associated with your Self-Custodial Wallet. Such information is provided for convenience and informational purposes only, on an as-is basis, sourced from blockchain records or third parties. Wirex does not verify, audit, or guarantee such information, and it may not accurately reflect your actual on-chain positions or entitlements. Any returns, yields, or rewards stated to be generated or distributed by On-Chain Infrastructure are estimates only, are subject to the On-Chain Infrastructure's own terms, governance, and prevailing on-chain conditions, and the actual return you receive may differ from any stated estimate and may be zero. Wirex does not guarantee any such return.
4.16. The creation, signing, and broadcasting of on-chain transactions, and your access to On-Chain Infrastructure, may occur through Third-Party Providers, including blockchain networks, relays, and infrastructure operators. Wirex is not responsible for any failure, breach, or downtime affecting any Third-Party Provider.
4.17. Wirex may restrict or block access, through Wirex One, to certain On-Chain Infrastructure, digital assets, or blockchain addresses where required to comply with applicable law, sanctions, or regulatory requirements, or in accordance with Wirex's risk management policies. Such measures do not give Wirex the ability to access, seize, freeze, or otherwise exercise control over digital assets held in your Self-Custodial Wallet, or to initiate any transaction from it.
4.18. The On-Chain functionality, and On-Chain Infrastructure made available for interaction through it, may be added, changed, suspended, or removed at any time without notice. Removal of On-Chain Infrastructure from Wirex One does not affect any on-chain position you may already hold directly with that On-Chain Infrastructure.
4.19. Wirex may suspend or discontinue the On-Chain functionality, in whole or in part, at any time. Because the On-Chain functionality is non-custodial, Wirex does not hold your digital assets or private keys, and any such suspension or discontinuation does not affect your ability to access your Self-Custodial Wallet, or any digital assets held in it or in any On-Chain Infrastructure, through other compatible interfaces.
4.20. Participation in any On-Chain Infrastructure is entirely at your own discretion and risk. Nothing made available through Wirex One constitutes a recommendation, endorsement, guarantee, verification or representation regarding any On-Chain Infrastructure.
5. Your Profile
5.1. Creation of a Wirex user profile (the "Wirex Profile") is required only if you wish to access Regulated Services.
5.2. To create a Wirex Profile, you must provide the required information, including an email address and security credentials, and complete identity verification procedures.
5.3. The creation or existence of a Wirex Profile does not affect the non-custodial nature of your Self-Custodial Wallet, and digital assets held in your Self-Custodial Wallet remain under your sole control.
5.4. Wirex does not guarantee that a Wirex Profile will be made available to you or that access to any Regulated Service will be granted or maintained.
5.5. You must ensure that all information provided in connection with your Wirex Profile is accurate and up to date and must comply with any requests for additional information, including in relation to identity verification and source of funds, as required by applicable law or Wirex's policies.
5.6. You are responsible for maintaining the security of your Wirex Profile and any credentials associated with it. Credentials used to access your Wirex Profile are separate from, and do not replace, the authentication credentials used to control your Self-Custodial Wallet.
5.7. To be eligible to create a Wirex Profile, you must meet the following criteria:
(a) you must be at least 18 years of age and resident in a supported jurisdiction;
(b) you must not be from a Prohibited Territory;
(c) you must not be subject to sanctions or appear on any applicable sanctions list;
(d) you must successfully complete all required verification and compliance checks.
5.8. You must not create or maintain more than one Wirex Profile, and any duplicate or additional profiles may be suspended or terminated by Wirex.
5.9. You have the right to cancel your Wirex Profile within fourteen (14) calendar days from the day after its creation by notifying Wirex through the available customer care channels.
5.10. If you cancel your Wirex Profile within this period, your Wirex Profile and access to Regulated Services will be terminated. Any associated account will be closed subject to completion or cancellation of any pending Regulated Services and to any instructions required under applicable law. Your Self-Custodial Wallet will remain unaffected and under your sole control.
5.11. You may be required to pay for any Regulated Services already provided at your express request before cancellation, but only where you were informed of the cost in advance and agreed to such services being performed before the end of the cancellation period.
5.12. The right to cancel does not apply to Regulated Services that have already been fully performed and any transactions carried out through your Self-Custodial Wallet, which are irreversible by their nature.
5.13. The suspension, restriction, or termination of a Wirex Profile does not give Wirex control over, or access to, your Self-Custodial Wallet.
6. Your Profile Verification
6.1. In order to access Regulated Services of Wirex One, you may be required to complete identity verification procedures and provide information about yourself. Verification requirements may vary depending on the specific services you access, your jurisdiction, and applicable regulatory requirements. You must successfully complete our identity verification process. This includes, but is not limited to, providing:
(a) a valid, government-issued photo ID;
(b) proof of residential address dated within the last 6 months;
(c) completing biometric, liveness, or similar identity verification checks through our approved third-party provider, where required; and
(d) any additional documentation we may reasonably request.
6.2. In certain circumstances, we may require enhanced due diligence. This may involve:
(a) providing further personal, financial, or business-related information;
(b) information regarding the source of your funds and/or wealth;
(c) submitting additional supporting documents or financial statements;
(d) participating in a live video call or an in-person meeting with a Wirex representative or other relevant third-party partner.
6.3. You authorise Wirex to conduct identity verification checks, either directly or via approved third-party providers.
6.4. You acknowledge that, as part of our verification and compliance checks, we may use identity verification services, sanctions screening databases, credit reference agencies, fraud prevention bodies, and relevant third-party partners.
6.5. You acknowledge that, where certain services are provided by third-party providers, such providers may independently perform identity verification, customer due diligence, and ongoing monitoring in accordance with their own legal and regulatory obligations.
6.6. You are responsible for ensuring all information provided is accurate, truthful, and up to date. If your details change, you must update your information promptly. Inaccurate or outdated information may lead to restricted access to certain functionalities on Wirex One.
6.7. Wirex may monitor activity conducted through Wirex One, including profile activity, Regulated Service for compliance, sanctions, fraud prevention and security purposes. This monitoring does not mean that Wirex controls, intermediates or can reverse blockchain transactions.
6.8. We reserve the right to reject your registration on Wirex One if your identity cannot be verified or if any documentation you provide is incomplete, invalid, or suspected to be fraudulent.
7. Your Payment Account
7.1. Your Profile provides access to Regulated Services, which may include access to a payment account or similar mechanism made available by Wirex and/or through regulated third-party service providers (the "Account") solely for the purpose of facilitating transactions.
7.2. You may initiate fiat-related transactions using supported methods, including bank transfers, payment instruments, or conversion of digital assets, through functionality made available within your Profile.
7.3. We may refuse payments from bank accounts or payment instruments not registered in your name. You are responsible for ensuring that all payment details provided are accurate and complete, as well as for any fees charged by your bank or payment provider.
7.4. Where you initiate a transfer, you must ensure that the currency sent matches the selected currency of your Account. If you send a different or unsupported currency, conversion fees, delays, or rejection of the payment may apply.
7.5. You acknowledge and agree that exchange rates displayed prior to execution are indicative and may change before your transaction is executed. The applicable exchange rate will be fixed at the time your order is executed, and you bear any risk arising from any fluctuations prior to such execution.
7.6. Where a payment transaction is made through your Wirex Profile, your rights and liabilities in respect of unauthorised or incorrectly executed transactions will be governed by applicable law.
7.7. You must notify Wirex without undue delay if you become aware of any unauthorised or incorrectly executed payment transaction carried out through Regulated Services.
7.8. To the extent permitted by applicable law, Wirex shall not be liable for any losses resulting from unauthorised access to your email account, device, or other third-party services, unless such access results from Wirex's breach of its obligations in relation to the Regulated Service.
8. Account Identifiers
8.1. Wirex One may enable access to Regulated Services through the use of bank account identifiers, including, without limitation, virtual IBANs ("vIBANs"), sort codes and account numbers, or other local bank account details assigned to you (the "Account Identifiers") as part of the Regulated Services of Wirex One.
8.2. Account Identifiers may allow you to receive funds to, and send payments using, such account identifiers using supported payment rails and currencies, including, without limitation, Single Euro Payments Area ("SEPA"), Faster Payments, or Automated Clearing House ("ACH").
8.3. Account Identifiers are provided by Wirex and/or through Wirex's integration with one or more regulated third-party service providers that facilitate the underlying payment infrastructure. You acknowledge and agree that:
(a) Wirex does not operate or control the underlying payment infrastructure;
(b) such account identifiers are issued, assigned, and maintained by Wirex and/or the relevant third-party service providers; and
(c) your use of Account Identifiers may be subject to additional terms and conditions imposed by such third-party service providers.
8.4. Account Identifiers form part of the regulated functionality of Wirex One and are separate from the Self-Custodial Wallet and On-Chain functionality described elsewhere in these Terms.
8.5. Wirex may, acting reasonably and in accordance with applicable law:
(a) assign, withdraw, or suspend any account identifiers allocated to you;
(b) suspend, restrict, or terminate your access to the Account Identifiers; or
(c) modify or discontinue Account Identifiers, including where any third-party service provider modifies or terminates its services.
9. Your Card and Card Services
9.1. You may request a payment card (the "Wirex Card") through Wirex One, which operates under the rules of the applicable card schemes (such as Visa or Mastercard).
9.2. Before using your physical Wirex Card, you must activate it in accordance with the instructions provided by Wirex and sign the back of the card in the designated signature panel. Activation is required to enable card functionality and constitutes your confirmation that you agree to be bound by these Terms. A virtual Wirex Card does not require a physical signature and is activated upon issuance. Where your Wirex Card has been migrated from another issuer, it will continue to operate without requiring re-activation or re-signature, unless a replacement physical or virtual Wirex Card is issued to you, in which case this provision applies.
9.3. To set up your Personal Identification Number (PIN), you must follow the instructions available within your Profile. Your PIN is required to complete certain transactions, including ATM withdrawals and chip-and-PIN payments. You may also be required to specify preferred currencies for your Wirex Card.
9.4. A transaction is authorised when you enter your PIN, use contactless functionality, provide card credentials online, or confirm the transaction in-app. The use of your card credentials, on its own, does not automatically constitute your consent to a transaction; whether valid consent has been given will be assessed in accordance with the authentication method used, applicable card scheme rules, and applicable law. Once authorised, a transaction may not be cancellable by you through Wirex One, although you may have refund, dispute or chargeback rights under applicable law, card scheme rules, or the relevant issuer terms.
9.5. You may use your Wirex Card to authorise payment transactions, where accepted, using digital assets held in your Self-Custodial Wallet.
9.6. When you use your Wirex Card, the corresponding transaction will be authorised by you and executed by Wirex through the interaction of your Self-Custodial Wallet with relevant payment infrastructure and third-party service providers.
9.7. Transactions made using the Wirex Card may involve the conversion of digital assets into fiat currency or equivalent value through third-party service providers prior to settlement with the relevant merchant or payment network.
9.8. You must ensure that sufficient digital assets are available in your Self-Custodial Wallet at the time of authorisation to cover the full amount of any transaction, including applicable fees and foreign exchange costs. Wirex and/or relevant third-party service providers may also require source-of-funds or other compliance checks.
9.9. The Wirex Card does not provide any credit facility. Transactions may be declined due to insufficient assets, applicable limits, security or regulatory checks, or merchant or network acceptance rules.
9.10. Where a transaction is made in a currency different from your Wirex Card currency, applicable exchange rates (including those set by the relevant card scheme or service providers) and any associated mark-ups or fees will apply. The final settlement amount may differ from the amount authorised.
9.11. Where a merchant issues a refund and/or your Wirex Card has been closed, suspended, or has expired by the time the refund is received the amount will be credited by Wirex to your Self-Custodial Wallet once received from the relevant card scheme. This may take several business days. Where the refund currency is not supported, it may be converted at applicable exchange rates and fees.
9.12. You may request a chargeback by contacting Wirex which will process such requests in accordance with applicable card scheme rules (such as Visa or Mastercard rules). Supporting evidence may be required. The outcome and processing timeframe are determined by the relevant card scheme. Disputes with merchants or ATM operators must be addressed directly with them where required.
9.13. Your Wirex Card will expire on the date indicated on the card. A replacement card may be issued or made available upon request. Expired physical cards should be securely destroyed.
9.14. You may initiate a transfer to an external Visa or Mastercard (the "Recipient Card") using the Account-to-Card ("Pay-to-Card") service, subject to availability, using digital assets held in your Self-Custodial Wallet.
9.15. Such transfers are executed through the interaction of your Self-Custodial Wallet with payment infrastructure and third-party service providers and may involve conversion of digital assets into fiat currency or equivalent value prior to settlement. Account-to-Card transfers are funds transfers and do not constitute card purchase transactions.
9.16. Once authorised and completed, transfers are final, may be irreversible, and chargeback rights applicable to card purchases do not apply.
9.17. Transfers may be delayed, declined, or partially completed due to AML or sanctions requirements, risk controls, applicable limits, geographic restrictions, technical issues, third-party dependencies, or card scheme rules. Processing times are determined by the Recipient Card issuer and relevant service providers.
9.18. Transfers are subject to applicable limits, supported countries and currencies, and fees as displayed within Wirex One. Exchange rates and fees applied by third-party service providers and payment networks may also apply.
9.19. You must ensure that Recipient Card details are accurate. Wirex is not responsible for misdirected transfers resulting from incorrect information. Attempts to recover funds may be made where requested, but recovery is not guaranteed and may incur a fee.

10. Profile Closure, Suspension and Termination
10.1. You may request to close your Wirex Profile at any time by contacting Wirex through available customer care channels. (c) this is required to comply with applicable law, regulation, court orders, or directions from a competent authority;
(d) required as part of AML, sanctions, or risk management processes; or
(e) continued provision of services may expose Wirex or third parties to risk.
10.4. Wirex may also suspend or restrict access to your Wirex Profile while investigating suspected breaches or suspicious activity, where continued access could result in harm or regulatory breach.
10.5. Where permitted by law, Wirex will notify you of any suspension or termination of your Wirex Profile or access to Regulated Services. Such notification, however, may be delayed or withheld where Wirex is not permitted to provide it. Wirex may also terminate your Wirex Profile or access to Regulated Services at any time by providing you with at least two (2) months' notice.
10.6. The suspension, restriction, or termination of a Wirex Profile does not affect your Self-Custodial Wallet, which remains under your sole control and is not accessible to Wirex.
10.7. Following closure, you may still be required to complete or cooperate with any compliance processes required by applicable law.
10.8. Nothing in this section limits or affects your statutory rights under applicable law.

13.3. Where you use Regulated Services in breach of these Terms, or where a technical or processing error results in an unintended benefit to you in connection with such functionality, Wirex may take reasonable steps to recover any amounts due in connection with Regulated Services, including by restricting or suspending access to such functionality or offsetting amounts processed through it, in each case in accordance with applicable law.
13.4. Wirex One is provided on an "as is" and "as available" basis. To the extent permitted by law, Wirex makes no representations or warranties as to the suitability, reliability, availability, or fitness of Wirex One for your particular purposes.

14.2. You are responsible for maintaining access to and control over your Self-Custodial Wallet, including safeguarding your authentication credentials, devices, and recovery mechanisms, and for all transactions authorised through your Self-Custodial Wallet.
14.3. You are responsible for maintaining copies of any information or data you upload or store through Wirex One. Wirex is not responsible for any loss of data or loss of access resulting from the suspension, restriction, or termination of your access to Wirex One.
15. Wirex Remedies

16.1. How we collect, use, share, and retain your personal data is explained in our Wirex One Privacy, Data Use and Retention Policy, available on our website. This includes information about identity verification and any biometric or liveness checks, sanctions screening, fraud prevention checks, credit reference agencies, and relevant third-party partners, where applicable.
16.2. Where your personal data is transferred from TRANSACT to Wirex, such transfer will be carried out in accordance with applicable data protection law and our Privacy, Data Use and Retention Policy.
17. Intellectual Property
17.1. All intellectual property rights in the Wirex One, and all content and logos are owned by or licensed to Wirex. You may not copy, imitate, or use any of this intellectual property without our prior written consent. Nothing in these Terms grants you any intellectual property rights in the Wirex One, other than the right to use the Wirex One, and to download Wirex One App on your device in order to access the Wirex One, in accordance with these Terms.
17.2. Your right to use the Wirex One is personal to you and you are not allowed to give this right to any other person. Your right to use the Wirex One does not stop us from giving other people the right to use the Wirex One.
18. Apple App Store Provisions
18.1. This Section applies where the Wirex One App has been acquired from the Apple App Store. You acknowledge and agree that the Terms are solely between you and Wirex, not Apple, Inc. ("Apple") and that Apple has no responsibility for the App or content thereof. Your use of the Wirex One App must comply with the App Store Terms of Service.
18.2. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and (where applicable) Apple will refund the purchase price for the Wirex One App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Wirex One App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be solely governed by the Terms and any law applicable to Wirex as provider of the Wirex One App.
18.3. You acknowledge that Apple is not responsible for addressing any claims of you or any third party relating to the Wirex One App or your possession and/or use of the Wirex One App, including, but not limited to:
(a) product liability claims;
(b) any claim that the Wirex One App fails to conform to any applicable legal or regulatory requirement; and
(c) claims arising under consumer protection or similar legislation; and all such claims are governed solely by the Terms and any law applicable to Wirex as provider of the software.
18.4. You acknowledge that, in the event of any third-party claim that the Wirex One App or your possession and use of that Wirex One App infringes that third party's intellectual property rights, Wirex, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim to the extent required by the Terms.
18.5. You represent and warrant that
(a) you are not located in a country that is subject to U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and
(b) you are not listed on any U.S. Government list of prohibited or restricted parties.
18.6. You and Wirex acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of the Terms of Service as relates to your license of the App, and that, upon your acceptance of the terms and conditions of the Terms of Service, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms of Service as relates to your license of the App against you as a third-party beneficiary thereof.
19. Other App Distribution Platform Provisions
19.1. Where you download our Wirex One App from any other app store or distribution platform other than the Apple App Store, including the Google Play Store (the "Distribution Platform") you agree that:
(a) these Terms are between you and Wirex, and not with the provider of the Distribution Platform ("Store Provider");

(c) the Store Provider is only a provider of the Distribution Platform where you obtained the Wirex One App;
(d) Wirex, and not the Store Provider, is solely responsible for the Wirex One App;
(e) the Store Provider has no obligation or liability to you with respect to the Wirex One App or these Terms; and

20. Amendments to These Terms
20.1. We may change these Terms from time to time. Except where clause 21.2 applies, we will notify you of any change at least two (2) months before the date on which it takes effect. Notice will be given in a durable medium. You will be treated as having accepted the change unless you tell us before the effective date that you do not accept it. If you do not accept the change, you have the right to terminate these Terms and close your Profile immediately and free of charge at any time before the effective date.
20.2. We may make the following changes with shorter notice or with immediate effect:
(a) changes to interest or exchange rates that are based on the reference rates identified in our Fees and Limits;
(b) changes required by a change in applicable law or by a binding instruction of a competent authority, where the law or instruction requires the change to take effect on a date earlier than two months from notification;
(c) changes that are unambiguously in your favour (for example, a reduction in fees, a removal of a restriction, or a new service made available to you at no charge); and
(d) changes to operational or technical information referenced in these Terms (such as supported app versions, supported browsers, or support contact details) that do not affect your rights or our obligations under these Terms.
20.3. We will tell you about any changes to these Terms made under this clause as soon as reasonably practicable after they take effect.
21. Miscellaneous
21.1. These Terms shall be governed and interpreted in accordance with laws of England and Wales.
21.2. Unless stated otherwise in these Terms, if any provision is found to be invalid or unenforceable by a court or competent authority, such provision shall be deemed modified or, if necessary, struck out to the extent required, and the remainder of these Terms shall remain in full force and effect.
21.3. The failure or delay by Wirex in exercising any right or enforcing any provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be made in writing to be effective. All rights and remedies under these Terms are cumulative and not exclusive of any rights or remedies provided by law.
21.4. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Wirex may assign or transfer its rights or obligations under these Terms at any time. Where such assignment or transfer materially affects your rights or our obligations under these Terms, including a change in the entity providing Regulated Service to you, we will notify you in accordance with the "Amendments to These Terms" section; otherwise, such assignment or transfer may take place without notice. No third party shall have any rights to enforce any part of these Terms.
21.5. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in this clause deprives a consumer of any protection afforded to them by mandatory provisions of the law of the country in which they are resident, including, to the extent required by such mandatory law, the right to bring or defend proceedings in the courts of that country. Nothing in these Terms shall affect the user's statutory rights as a consumer under the laws of their country.
21.6. In the event of a dispute arising from the interpretation and/or application of these Terms:
(a) If you are a consumer resident in the United Kingdom, these Terms and any non-contractual obligations arising out of them are governed by the law of England and Wales.
(b) For all other users, disputes shall likewise be subject to the exclusive jurisdiction of the courts of England and Wales in accordance with the paragraph above, save to the extent a court of your domicile or residence has mandatory jurisdiction under applicable law that cannot be excluded by agreement.
